These Terms and Conditions (“Terms”) govern your access to and use of the online IQ testing platform available at MiTest and its related pages, including mitest.de/test/intelligence-test (collectively, the “Service”). The Service is operated by COREGISTROS, SLU, a Spanish company subject to Spanish law, including the Ley de Servicios de la Sociedad de la Información y del Comercio Electrónico (LSSI-CE), the Ley de Servicios de Atención al Cliente (2025) and, where applicable, UK online commerce and consumer protection laws.

By accessing or using the Service, whether as a Visitor, Registered User or Subscriber, you acknowledge that you have read, understood and agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

These Terms incorporate by reference our Privacy Policy and Cookie Policy, each available through separate links on the website. Those documents provide further detail regarding the processing of personal data, tracking technologies, and the rights of users under applicable laws.

We may update or modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. In case of material updates affecting your rights or obligations, we may also notify you by email or through an in-platform notice. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Definitions

For purposes of these Terms:

  • “Visitor” means any individual who accesses or browses the website without creating an account.
  • “Registered User” means any person who creates an account on the Service by providing registration information.
  • “Subscriber” means a Registered User who purchases access to premium features, paid IQ test reports, or subscription-based services.
  • “User” means collectively Visitors, Registered Users, and Subscribers.
  • “Service” refers to all website content, IQ tests, scoring systems, algorithms, user accounts, premium features, subscriptions, and any related services or functionality provided by MiTest.
  • “Content” means all website materials, including text, graphics, algorithms, test questions, scoring logic, images, and software.
  • “User Content” means any data, text, or other material submitted by a User, including information provided during registration.
  • “Third-Party Providers” refers to external companies that process payments, store data, or support parts of the Service (e.g., Stripe or similar payment processors).
  • “Subscription” means any recurring, automatically-renewing paid plan offered through the Service.
  • “One-Time Purchase” means a non-recurring purchase of a specific service or test result.


3. Eligibility and Access to the Platform

The Service is intended for individuals aged 16 or older. By using the Service, you represent that you meet this minimum age requirement. Users under 18 may be required to obtain permission from a parent or legal guardian under applicable national laws.

3.2
The Service is accessible worldwide. You are responsible for ensuring that access and use are permitted in your jurisdiction. Some features may not be available in certain countries due to technical, legal, or commercial restrictions.

You agree to provide accurate, complete, and up-to-date information when using the Service, especially during account creation and payment processes. Failure to do so may limit or prevent access to certain features.

3.4
We reserve the right to refuse access, suspend functionality, or terminate accounts if we reasonably believe that a User has violated the Terms, applicable laws, or attempted to misuse the Service.

4. Description of Services

MiTest provides access to online IQ tests, cognitive analytics, scoring algorithms, and optional premium features. Certain results or detailed reports may require payment or an active subscription.

4.2
The Service may include:

  • Free access to general test questions
  • Premium IQ test reports
  • Detailed cognitive insights
  • Personalized analytics or recommendations
  • Subscription-based enhanced features
  • User account tools (My Account, My Settings, etc.)


4.3
The Service is not intended to provide medical, psychological, psychiatric, or clinical advice. IQ scores and related insights are for informational and entertainment purposes only.

4.4
We may modify, update, or discontinue portions of the Service at any time. This may include test formats, scoring methods, subscription features, or user interface changes. We do not guarantee uninterrupted or error-free access.

5. User Account Registration

5.1
To access certain features, including premium services, you must create an account and provide registration information such as your name, email address, and password.

5.2
You are responsible for maintaining the confidentiality of your login credentials and for all activities performed through your account. You must notify us immediately if you suspect unauthorized access.

5.3
We may send service-related communications (such as updates, legal notices, password resets, billing information, or account alerts). You may opt out of non-essential communications where legally permitted.

5.4
We reserve the right to suspend, restrict, or delete accounts that violate these Terms or are inactive for extended periods, subject to applicable legal retention obligations.

6. Personal Data & Privacy

6.1
Personal data you submit when creating an account, performing a test, subscribing, or interacting with the platform is processed in accordance with our Privacy Policy. Tracking technologies used on the website, including cookies, are governed by our Cookie Policy.

6.2
While you provide personal data, scoring responses, and other inputs, you retain ownership of all User Content, including registration information and the data you submit during your use of the Service.

6.3
Notwithstanding the above, you agree that MiTest may:

  • store copies of your registration information and User Content,
  • process such information as reasonably necessary to operate the Service, and
  • use it as described in these Terms, the Privacy Policy, and applicable regulations.

6.4
We do not store or process payment card information directly. Payments are handled exclusively by third-party payment processors (e.g., Stripe), and you agree that such third parties may store and process your payment information as required to complete transactions.

6.5
Further details regarding data rights, access, rectification, erasure, and international transfers are fully detailed in the Privacy Policy, which should be read in conjunction with these Terms.

7. Pricing, Payments, and Billing

7.1
Certain features of the Service may require payment, either as a one-time purchase or as part of a recurring subscription plan. The specific fees, billing periods, and available services will be displayed to you before completing any transaction.

7.2
All prices are shown in the currency indicated on the payment page. Taxes, VAT or other applicable fees may be added depending on your location and applicable regulations.

7.3
The Provider has the discretion to modify the prices of its services at any time. If a price change affects an existing subscription, you will be notified in advance—typically via email or within your account—and given an opportunity to cancel or manage your subscription before the new price takes effect.

In accordance with the Spanish “Ley de Servicios de Atención al Cliente” (2025), users must be notified at least fifteen (15) days in advance of any automatic subscription renewal or price change affecting an active subscription (usually by e-mail).

7.4
By completing a payment, you authorize us and our third-party payment processors (including, but not limited to, Stripe) to charge the payment method you provide. We do not store or handle your full payment card details. You agree that third-parties working on our behalf may store your payment information only to process and manage payments.

7.5
If you purchase a Subscription, you acknowledge that it may automatically renew for successive periods until you cancel it. Recurring charges will be billed to the payment method you provided at the time of purchase unless you update your billing information in your account.

7.6
If a payment fails, we may attempt to process it again. We may suspend or terminate access to paid features if billing problems are not resolved after reasonable attempts to notify you.

7.7
Unless required by law, the Provider does not guarantee refunds. Please review the “Cancellations and Refunds” section for more details.

8. Subscriptions, Cancellations, and Refunds

8.1 Subscriptions
Subscription plans renew automatically for the duration shown during checkout (e.g., monthly, quarterly, annual) until you cancel. Renewal terms will match the initial subscription period unless otherwise stated.

8.2 Cancellation by You
You may cancel your subscription at any time through My Account → My Settings on the home page. Cancelling stops future billing but does not retroactively refund payments already made. You will retain access to paid features until the end of the current billing period.

8.3 Suspension
If the Service offers the possibility to suspend a subscription (where available), you may do so through your account page. Suspension rules, timing, or limits will be clearly indicated if this option is enabled for your plan.

8.4 Refunds
Payments are generally non-refundable unless required by mandatory consumer laws.
The Provider may grant refunds at its sole discretion in exceptional cases.
Chargebacks without valid justification may result in account suspension.

8.5 Involuntary Cancellation
The Provider may cancel or restrict your subscription if:

  • repeated payments fail,
  • fraudulent activity is suspected,
  • required account information is inaccurate or misleading, or
  • you violate these Terms.

8.6 No Medical or Professional Guarantee
Paid reports and results do not guarantee accuracy, outcomes, or suitability for any purpose beyond entertainment and general information.

9. Intellectual Property Rights

9.1
All Content of the Service—including test questions, explanations, scoring algorithms, textual materials, graphics, icons, logos, layouts, software, frameworks, data compilations, and any other intellectual property—belongs exclusively to the Provider or its licensors. All rights are reserved.

9.2
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal and non-commercial purposes only. You may not copy, reproduce, modify, translate, adapt, rent, lease, loan, sell, publish, distribute, decompile, reverse engineer, disassemble, or create derivative works from the Service or any Content.

9.3
Any attempt to extract datasets, scrape content, replicate the scoring logic, or build competing services, tools, or models using the Service or its Content is strictly prohibited.

9.4 User Content
As previously stated:

The information you submit to us as part of your registration, and any data, text and other material that you may submit (“User Content”) remain your intellectual property. We do not claim ownership of such copyrights or proprietary rights. However, you agree that the Provider may retain copies and use such information as reasonably necessary for, or incidental to, the operation of the Service and as described in these Terms and in the Privacy Policy.

9.5
If you submit feedback, suggestions, or ideas, you grant the Provider a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.

10. Acceptable Use Policy

10.1
Users agree not to use the Service:

  • for illegal or unauthorized purposes;
  • to attempt to interfere with or compromise the system or security;
  • by using bots, scripts, scraping tools, or automated means;
  • to copy, extract or clone the test questions, scoring logic, or other proprietary Content;
  • to disrupt or overload the platform;
  • to impersonate another person or entity;
  • to use the Service for clinical, psychological, diagnostic or official assessments.

10.2
Any violation of this section may result in immediate termination of access and potential legal action.

11. Third-Party Services & External Links

11.1
The Service may include integrations with or links to third-party websites, payment processors, analytics tools, or external content. These are provided for convenience and informational purposes only.

11.2
The Provider does not endorse, control, or take responsibility for third-party websites, services, or content. Your interactions with such services are governed by their respective terms and policies.

11.3
Payment processing is handled exclusively by third-party providers such as Stripe or similar. You must comply with their applicable terms when completing payments.

12. Disclaimer of Warranties

12.1
The Service and all Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied.

12.2
We do not guarantee:

  • uninterrupted access to the platform,
  • error-free or accurate test results,
  • that the Service is free from viruses or harmful components.

12.3
IQ test outputs, cognitive insights, and related information are for entertainment and general informational purposes only, and should not be used for academic, clinical, medical, legal, or employment decisions.

13. Limitation of Liability

13.1
Limitation of liability to the maximum extent permitted by law, neither Mitest nor its service providers involved in creating, producing, or delivering the services will be liable for any incidental, special, exemplary or consequential damages, or damages for lost profits, lost revenues, lost savings, lost business opportunity, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute services of any kind arising out of or in connection with these terms or from the use of or inability to use the services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Mitest or its service providers have been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.

To the maximum extent permitted by the law of the applicable jurisdiction, in no event will Mitest’s total liability arising out of or in connection with these terms or from the use of or inability to use the services exceed the amounts you have paid or are payable by you to Mitest for use of the services or one hundred euros (100€), if you have not had any payment obligations to Mitest as applicable.

The exclusions and limitations of damages set forth above are fundamental elements of the basis of the bargain between Mitest and you.

13.2
Nothing in these Terms limits or excludes liability where prohibited by law, including consumer rights applicable in the UK or EU.

14. Indemnification

You agree to indemnify and hold harmless the Provider and its affiliates, employees, contractors, and agents from any claims, damages, liabilities, losses, or expenses arising from your use of the Service, your User Content, or any violation of these Terms.

15. Applicable Law and Jurisdiction

15.1
These Terms are governed by and interpreted in accordance with the laws of Spain, including the Spanish LSSI-CE, except where mandatory local laws apply.

15.2
For users located in the United Kingdom, mandatory consumer protection rights under UK law apply, including the Consumer Rights Act 2015 (“CRA”), which sets out consumers’ rights regarding the purchase of products, services, and digital content. Nothing in these Terms shall reduce or limit the protections afforded to you under the CRA.

15.3
In case of dispute, all users—including those in the European Union, the United Kingdom, or any other jurisdiction—may contact COREGISTROS at [email protected]. Users within the European Union may additionally use the European Commission’s online dispute resolution platform available at: https://consumer-redress.ec.europa.eu/index_es

15.4
As an online service accessible worldwide, for international users, MiTest makes no representation that the Services are accessible, appropriate or legally available for use in your jurisdiction, and accessing or using the Services is prohibited from territories where doing so would be illegal. You access the Services at your own initiative and users are responsible for compliance with local laws.

15.5
Agreement to these terms constitutes an agreement to pursue your claim on an individual basis and a waiver of the ability to pursue your claim in a class action.

16. Changes to the Terms

16.1
We may update these Terms from time to time. Updates will be effective when posted on the website unless otherwise stated.
